One such case, involving the absence of a guardrail on a freeway offramp, resulted in a precedent-breaking decision in the Court of Appeal that opened the door for victims to sue when previously courts had consistently rejected such claims. This landmark case, Hernandez et al. v. Caltrans (114 Cal.App.4th 376) which was decided in December 2003 took years of preparation and a determination to do everything necessary finally reach a six-figure settlement in 2004 (after the Supreme Court rejected Caltrans’ pleas for review of the Court of Appeal decision in favor of our client) for our closed-head trauma victim, but it was well worth it.
